TERMS AND CONDITIONS FOR ONLINE BOOKINGS
SECTION 1
GENERAL
- The person who makes booking will be accepting the terms and conditions on behalf of the whole party. It is this person’s responsibility to ensure that all members of the party are aware and accept the whole of these terms and conditions and obligations contained in them together with any other documents and information supplied by Rosemead Guest House.
- Please note that a contract is not made until acceptance of the booking by Rosemead Guest House issuing a Booking Confirmation.
- Our agreement incorporates the entire contents of the current 2009 tariff, the Booking Confirmation and in particular the General Information and Conditions of Booking (‘our agreement’). You must also note and comply with all reasonable guidance given by us and any notices at the Rosemead Guest House.
- Our agreement is governed by English Law and we agree to the non exclusive jurisdiction of the English Courts. We must both act reasonably in selecting or agreeing any jurisdiction including any forum for dispute.
- Should any part of our agreement be deemed by law to be void, the remainder of the agreement will, if capable, continue in full force and effect.
- Please note we accept no liability for loss or damage to your possessions unless due to our negligence.
- All bookings are subject to availability. Please note these conditions supersede all previous notifications and guidance we may have communicated to you.
SECTION 2
TARIFFS
We guarantee that the price of your booking will be as shown on your Booking Confirmation based on party size, the accommodation selected and any inclusions detailed.
All prices are subject to change without notice. Special offers cannot be used in conjunction with any other promotion.
SECTION 3
CHANGES TO YOUR BOOKING BY YOU
After completion of your booking you may wish to change some elements of the booking e.g. dates or type of accommodation (subject to availability).
In order to assist us to meet your requests, we would ask where possible you request such changes at least two weeks before the break start date.
But where you wish to make a substantial change within two weeks of your booking date, such as change of dates, this may be deemed a cancellation (see section CANCELLATION OF YOUR BREAK BY YOU).
Please note that any change of date may involve a change in price. The tariff for your revised stay will be that applicable at time of original booking. You must pay us any increase due or we will issue a credit note to you for any difference.
SECTION 4
CANCELLATION OF YOUR BREAK BY YOU
It may be necessary for you to cancel your stay due to changes in circumstances, accident or illness. We recommend you consider insurance cover as appropriate since cancellations can result in loss of all monies paid. Pease note all cancellations are subject to administration charge (see section 5). You may not transfer your booking to another party without our consent. As soon as you know that the booking will need to be cancelled, ring Rosemead Guest House on 0044 01372 462662 (Monday – Friday 10 am – 3 pm).
SECTION 5
CANCELLATION CHARGES
If the cancellation is more than 2 weeks in advance of your holiday date than: Provided we receive notice in writing you will be entitled to a refund or transfer of your booking cost.
If the cancellation is within 2 weeks of your holiday start date than: We will offer you a refund or transfer of monies paid, subject to deduction of cancellation charges shown. Cancellation charges will be calculated from the date which written or verbal notification is received by us to cover the cost and expense we incur as result of your cancellation as detailed below Cancellation of online booking:

Please note that above cancellation fees apply only if you book online. If you decided to book via office, charges will vary (see Terms and conditions for bookings other than online).
SECTION 6
CANCELLATION FOLLOWING NON ARRIVAL
If you have not arrived by 6 am the morning after your booking was due to commence, or contacted the Rosemead Guest House concerned to confirm when you will arrive, we will assume that the booking is cancelled. Please note that the total break cost will be retained.
IF WE CANCEL OR CHANGE YOUR BOOKING
We try very hard not to change or cancel your booking, but where it is necessary; we will advise you as soon as possible. If we cancel your booking or make any significant alternations such as changing your date of arrival or duration then you have a choice of:
- a replacement booking of a standard comparable to the original contract and of the same value paid, or
- a replacement booking of lesser value together with a payment from us to you of the difference in price between the replacement and the original contract, or
- a replacement booking of higher value with a payment of the difference in price between the original contract and the replacement payable to us, or
- a full refund.
In addition to the above we will also pay you compensation for any provable loss.
SECTION 7
CONDITIONS OF CARRIAGE
Where you take up the additional offer of airport service, all party members are subject to the terms and conditions of the relevant service operator(s).
Full details are available on request. Your contract is with relevant provider and Rosemead Guest House can not be held responsible for any delays, cancellations or other consequences resulting from such arrangements.
SECTION 8
LIMITATION OF LIABILITY
We accept responsibility for those arrangements for you stay which are within our control, but we cannot accept liability for any injury, loss or damage suffered by you or any member of your party, unless one of the following applies:
- there was a wilful default by us / our employees, or
- death or personal injury was caused by the negligence of us / our employees.
For all claims which result from the non-performance or improper performance of the contract by Rosemead Guest House, we will pay compensation that is reasonable in all circumstances.
SECTION 9
IF YOU HAVE A COMPLAINT OR COMMENT
You are asked to notify any shortcoming or complaints to the Rosemead Guest House Management as soon as possible so that wherever possible these can be remedied for you at the time. Any reported matter which has not been resolved during your stay should be advised in writing to the Management as soon as possible to enable us to carry out an investigation. Claims may be reduced or rejected if we have not been given the opportunity to put matters right during your stay.

OTHER
Please note we do not issue VAT receipts.
If any information contained on the Booking Confirmation is incorrect, or subsequently becomes incorrect, please telephone the Rosemead Guest House immediately.
